DEFINED FITNESS FREE TRIAL POLICY & LIABILITY WAIVER
Defined Fitness offers a 7-day free trial program to prospective members. Free trials are not available to anyone under the age of 18 and limited to local residents and new members only. The free trial program allows prospective members to access all Defined Fitness locations, amenities, and services. The 7-day free trial begins once a prospective member collects their trial barcode from the club location designated on the online trial form.
Because physical exercise can be strenuous and carries inherent risks, Defined Fitness strongly recommends obtaining a physical examination from a doctor before using any exercise equipment or participating in any exercise activity.
LIABILITY WAIVER
I agree that if I engage in any physical exercise or activity, or use any club amenity on the premises or off-premises at a sponsored club event, I do so entirely at my own risk. This includes, without limitation, my use of the locker room, parking area, sidewalk area, or any equipment in the premises. I assume all risks of injury, illness, damage, loss, or theft of any personal property. I also agree to abide by all club rules and regulations.
IN CONSIDERATION OF HAVING ACCESS TO DEFINED FITNESS’ PREMISES, SERVICES, EQUIPMENT, FACILITY, AND AMENITIES, I (on behalf of myself, my spouse, children, heirs, personal representatives, executors, assigns, and anyone claiming by or through any of the foregoing) HEREBY RELEASE, FOREVER DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS DEFINED FITNESS (including all affiliates, owners, directors, officers, employees, agents, successors, and assigns) FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION, INCLUDING, WITHOUT LIMITATION, CLAIMS FOR PERSONAL, BODILY, OR MENTAL INJURY, INJURY DUE TO CONTAGIOUS DISEASES, INCLUDING BUT NOT LIMITED TO COVID-19, ECONOMIC LOSS, OR ANY DAMAGE TO ME, MY SPOUSE, GUESTS, UNBORN CHILD, OR RELATIVES RESULTING FROM THE NEGLIGENCE OF DEFINED FITNESS OR ANYONE ON DEFINED FITNESS’ BEHALF OR ANYONE ON THEIR PREMISES, WHETHER RELATED TO EXERCISE OR NOT.
I have carefully read this waiver and release and fully understand that it is a release of liability. I voluntarily give up any right that I may otherwise have to bring a legal action against the club for negligence, or any other personal injury, property damage, or loss.
